Discovery

Both parties in the injury litigation case disclose relevant information and documents before trial through interrogatories or requests for admission, depositions (oral interviews under oath), and production and inspection of documentation.

Pre-trial motions

Lawyers may enter motions to resolve the case, such as:

• Summary judgment-undisputed facts compel a ruling without trial
• Motion to dismiss-lack of material facts require dismissal of the case
• Default judgment-lack of defendant response or appearance prevents defendant from contesting the case and the court rules on damages

Trial

Trial begins with jury selection (except in a bench trial when only a judge rules). Lawyers give opening statements. Judgment and appeal

Of course, sometimes it is difficult to know just how competent or willing to go the extra mile your attorney is until you have seen him or her in action. Keep in mind that if at any point you are dissatisfied with your attorney's performance or uncomfortable with any aspect of your representation, you can choose another attorney to represent you. Although admittedly this is not the outcome one would hope for, the process of switching to a new disability attorney does not require a lot of paperwork on your part. Remember, when choosing a social security disability attorney, it's best to treat the relationship as you would with any other person who provides you with a service. If you are not satisfied with the work, you should either ask for it to be corrected or, if your needs are not being met, find someone else who you feel can get the job done. Today, we're going to talk about what's known as a collection statute expiration date (CSED), and the IRS will sometimes call it the COSED. I'm not really sure -- it's not really an accurate acronym, but that's what they call it. It stands for the proposition that a tax liability only has a 10 year lifespan. The IRS only has 10 years from the date of the assessment of a tax to collect it. This holds true for income tax and payroll tax, and so it can actually be a very helpful tool in the resolution of IRS problems. I just said it was 10 years from the date of the assessment. What does that really mean in English? Here's what it means. When the IRS goes ahead and puts a liability in the books, and it becomes formally due and payable by you, the taxpayer, that's essentially an assessment. Assessments can happen up to three years in normal cases after the filing of a tax return. So you never know when an assessment was actually posted. Typically, the filing of your return is what triggers an assessment if you owe tax, and the 10 year time clock will start to run. When can that assessment actually be later than when you file a tax return? When you get the little love letter that says hey, you made a mistake on your return, and you actually owe us more money. So you can actually have an assessment after the initial assessment. Olsen's husband, Kenneth, who was also shot but survived, initially identified another man as the killer. Julius Butler, a Black Panther and police informant, fingered Geronimo Pratt as the killer. In 1970 Pratt was arrested and charged with murder and kidnapping. His attorney, Johnnie L. Cochran Jr., assured his client that the charges would be dropped, given that Pratt had been 350 miles away on the night of the murder and could prove it. But they were met with surprising setbacks, from lying prosecution witnesses trooped to exculpatory evidence disappearing at police stations and the LA District Attorney's office. Later it was revealed that FBI "moles" had infiltrated defense sessions and monitored Cochran's phone calls. Pratt always maintained his innocence. During his incarceration he studied law and steadfastly built a defense. Pratt was represented by attorneys Stuart Hanlon and Johnnie Cochran in his original trial. Together with William Paparian, Hanlon contributed much to the appeals that later led to Pratt's conviction being vacated. Pratt's conviction was vacated on June 10, 1997, on the grounds that the prosecution had concealed evidence that might have exonerated the defendant.
