DUI Defense - The One-Leg Stand

If you have been arrested for driving under the influence, the arresting officer probably asked you to perform the so-called "One-Leg Stand" test. The one-leg stand is typically one of several methods that police officers use to decide whether to arrest someone for driving while intoxicated.

The one-leg stand is a method devised by the National Highway Traffic Safety Administration to determine whether a person has a blood-alcohol content ("BAC") greater than 0.10 percent. The one-leg stand is supposed to be performed by balancing on one leg while holding the foot of the other leg approximately six inches off the ground and simultaneously counting out loud while staring at the raised foot and holding the arms at the side. Officers are supposed to note any of the following "clues":
(1) swaying while balancing;
(2) use of the arms for balance;
(3) hopping; and
(4) putting the foot down.

Appeals Lawyer

Many police officers and prosecutors have cultivated a myth that this test is useful in determining whether a driver has had too much too drink. In fact, it is a very poor test for determining intoxication and it has never been subjected to rigorous scientific testing. There are several reasons why the one-leg stand may not adequately support an arrest or conviction for a DUI or DWI.

DUI Defense - The One-Leg Stand

First, the federal government acknowledges that even under the best conditions the one-leg stand is an unreliable predictor of a person's intoxication. Under laboratory circumstances (i.e., not late at night on the side of the road), officers trained in using the one-leg stand to determine if a person had a BAC greater than 0.10 percent were wrong 35 percent of the time. In other words, under the best circumstances, the one-leg stand test was correct only 65 percent of the time. It stands to reason that the usefulness of the one-leg stand test is worse under less than ideal conditions.

Second, the one-leg stand is subject to too many confounding variables to be useful evidence of guilt. The test requires a dry, hard, level and non-slippery surface. Imperfections in the surface on which the person is balancing will obviously affect that person's ability to balance on one leg for a prolonged period. Moreover, each person's physical characteristics will likewise impact that person's ability to balance on one leg for a prolonged period of time. Indeed, the federal government acknowledges that persons who are over 65 years old, have back, leg, or inner ear problems, or who are overweight by 50 pounds or more had difficulty performing this test regardless of alcohol intoxication.

Third, the arresting officer may not have administered the test correctly. The one-leg stand is supposed to be a standardized test. Even the federal government acknowledges that the test must be administered and interpreted in a standardized manner for the results to have any meaning. Shortcuts by the arresting officer in administering the test, failing to provide complete and correct instructions, or noting false "clues" of intoxication will undercut the validity of the test.

It is important to recognize these remarkable shortcomings in the evidence that the police and prosecutor will attempt to use against you. Because the one-leg stand is so flawed, it should not be used as evidence at all. Although many judges will allow it into evidence, it is nevertheless important to educate the judge or jury about the flaws so that they can discount the officer's conclusion that you failed the test. Make sure that you hire a DUI defense lawyer who understands the inherent flaws in the one-leg stand and knows how to use science to undercut the prosecutor's case.

Then the movie shows an airplane carrying a passenger to an Indian reserve, where they're blockading construction/forestry equipment from clearcutting on Indian land. We later realize that the individual was a lawyer representing the tribe whose land is going to be clearcut and the protesters are angered at the lawyer losing the case & the lawyer came to discuss an appeals process. Wilf (Westerman) is introduced at this time & then he in turn introduces Arthur, who also kidnaps the logging company's general manager, and the four take off through the woods where Arthur "instructs" them in listening to Mother Earth. Surrealistic, in its entirety, throughout the movie you're taken for a ride that will take you through many thought provoking scenes. The reason for this proposed law is centered around a crime in 2007 where the suspects ran a drug deal that occurred in Venezeula and France but planned it while in Miami, Florida. The prosecution tried to bring them up on US charges but the court threw the case out since the actual crime had not occurred in the US. While David agrees that morally it is wrong to plan any crime regardless of where it is perpetrated, but making that a crime of its own will open a Pandora's Box. The US Justice system is already overwhelmed with too many cases, Federal prosecutors' issues with ethics, and frivolous lawsuits. Confused by the number of courts the legal system uses? We don't blame you! There are many and the differences between them can range from minor to major. If you have any questions please comment or contact us and we will try to help answer your question.

First of all there are two major court branches: Federal and State.

We will first break down the Federal court system and follow that with the State court system.

US District Court Info

There are 94 US District courts.
Each state has at least one.
Each court has at least 2 judges and can have as many as 28.
This is where most federal cases begin!
These courts can here both criminal and civil cases.

U.S. Circuit Courts of Appeal

13 Circuit Courts of Appeal in the United States.
Anyone found guilty in any court of law may appeal their case to the appropriate court of appeal in their regional area. Federal appeals go to the Federal Court of Appeals which is in Washington D.C.
These courts are usually overseen by three judges.

U.S. Supreme Court

This is the top of the US court system.
It consists of 9 judges (called Justices) that are appointed to life terms by Presidents of the United States. The head judge is called the Chief Justice.
Citizens who are not satisfied with the results of the Appeals courts or State Supreme Courts can petition the U.S. Supreme Court.
This is typically done by filing a Petition for a Writ of Certiorari.
The court typically hears between 100 and 150 cases out of an average of 7,000 petitions.(around 1 in 50-70 depending on the year and number of cases seen and petitioned)
4 Justices must agree to hear the case (this is called a grant cert).

Special Article III Courts

1. U.S. Court of Claims: Handles lawsuits against the Government and is found in Washington D.C.
2. U.S. Court of International Trade: Handles international trade disputes and tariffs. This court can be found in New York.

Special Courts Created by Congress

1. Magistrate judges: Handle certain criminal and civil matters agreed to by all parties involved.
2. Bankruptcy courts: Handles bankruptcy and bankruptcy code and law.
3. U.S. Court of Military Appeals: The final appellate court for those that fall under the Military court system.
4. U.S. Tax Court: Handles cases involving tax fraud and other tax related issues.
5. U.S. Court of Veterans' Appeals: Denial of Vet benefits can be taken here (along with other Veterans' issues).

State Court Systems

All state court systems have some differences, but the similarities are strong enough that we can at least give an overview and general feel for how they all work.
Trial Courts of Limited Jurisdiction
Most of the cases that come to one of these courts are overheard by a single judge without a jury.

1. Probate court: Handles the estates of those that have died. Makes sure that the will is properly executed.
2. Family court: Handles such things as annulments, divorce, custody, child support, alimony, adoption, and other typical family legal issues.
3. Traffic court: The typical location that minor traffic incidents are handled.
4. Juvenile court: This court handles cases of children who have committed crimes. In some states it is under 18 - others it can be 21.
5. Small claims court: Civil matters are handled here and typically involve cases with damages under ,000.
6. Municipal court: City ordinance violations are typically handled here.

Trial Courts of General Jurisdiction

These are the main trial courts in the state system.
They can involve both civil and criminal cases.
Typically one judge with a jury hears the cases here.
These courts are usually called one of the following: Circuit courts, Superior courts, Courts of common pleas, and Supreme courts.

Intermediate Appellate Courts

Many states have intermediate courts which fall between the typical trial courts (listed above) and the state Supreme courts (listed below).

In states with these courts this is the first step in the appeals process.

Typically these are a matter of right (meaning the court -must- hear them regardless of their validity).
The only address errors of law and procedural mistakes.

Typically two or three judges review cases in these courts.

Highest State Courts (often state Supreme courts)

All states within the U.S. have some form of High Court.

They are usually called State Supreme Courts, however in some places they are called courts of appeal (Maryland is an example of this).

States that do not have intermediate courts (the type of court listed prior to this) usually allow appeals to this level of court as a matter of right (again, any case will be heard regardless of validity).

Like the intermediate courts, these courts usually hear cases based on error of law and not on facts of the case itself.

These courts tend to be overseen by panels of judges (3,5,7, or 9).
