11/29/2011 Lawyers representing convicted assassin Sirhan Sirhan argue in newly filed court documents that a bullet was switched in evidence at his trial and new forensic details show he is innocent of the 1968 killing of Sen. Robert F. Kennedy. In the latest of many appeals filed on behalf of Sirhan, the attorneys are seeking to overturn his conviction. They repeated a previous assertion and presented reports from experts who said Sirhan was programmed through hypnosis to fire shots as a diversion for the real killer. Prosecutors had no comment, said Lynda Gledhill, a spokeswoman for the California attorney general's office, which is handling the appeal. The lawyers, William F. Pepper and Laurie Dusek, also said sophisticated audio tests recently conducted on recordings from the assassination night show 13 shots from multiple guns were fired -- five more than Sirhan could have fired from his small pistol. Authorities have claimed eight bullets were fired, with three hitting Kennedy and the rest flying wildly around the kitchen and striking five other victims who survived. A bank levy is when your bank account is frozen and all or part of the monies in your bank account is seized. Bank levy's can happen for many reasons, however the two most common are due to unpaid taxes and unpaid debt.
A bank levy just doesn't happen immediately; usually it is the result of a creditor trying to force a debtor to repay a debt. Obviously in the case of taxes, if the IRS has sent you a letter stating that you owe taxes and you either refuse to pay the debt or don't respond to their requests by either making a repayment plan or trying to work with them towards repayment, a tool they will use is a bank levy. They will freeze your accounts and seize any money in your account up to the amount that you owe.

The bank account can be almost any type of account (e.g. savings, checking, etc) and while most levy's occur in the US, the IRS or other creditors can sometimes go after off shore accounts. Once a bank levy is made on your account, any money that is in the account will be seized. If there is not enough money in the account, all money will be removed and your account will usually remain frozen until the debt is paid off.
What is a Bank Levy?
It should be noted that while the IRS are usually the ones that use this method the most, other creditors have used this method to receive repayment for their debts. For instance, if you have a judgment against you for a credit card debt, the creditor can file for a bank levy to be placed on your account. While state laws differ, in most cases certain monies in your account are exempt including welfare payments, social security payments, VA benefits, child support, etc. If a bank levy has been placed on your account by a creditor, you usually have 30 days to contest the levy (in the case that monies that were seized are exempt). If a bank levy occurs, you should contact the court to find out how to file for an exemption immediately.
It should be noted that a bank levy can occur quite frequently and it is not a one time event. A creditor can request a bank levy as many times as he or she would like to until the debt is paid off. Many banks charge a penalty to their customers if their bank account receives a levy. This amount can be over 0 each time. It should be noted that any checks that have been written before the event that have not been cashed will bounce, because your account is frozen. It should also be noted that withdrawals can not occur, but in many cases deposits can. So if you have received a bank levy and have your employer deposit money into your account, this money will be seized as well.

Millionaire lawyer wants divorce do-over Five years after his divorce, Steven Simkin cries foul when a scandal wrecks his net worth. Steven Simkin is a partner at Paul, Weiss, Rifkind, Wharton and Garrison, a tony New York City law firm where partners made around $3 million each last year. He owns a $4.1 million home in leafy Westchester County. When he and his wife divorced in 2006 after 33 years of marriage, they had total assets worth $13.2 million. So Simkin (pictured) is doing OK for himself. But perhaps not OK enough: He now wants a do-over on that divorce settlement, after being taken in by Bernie Madoff's massive fraud. Claiming "extreme hardship" and that he has been "gravely damaged" by the Madoff scam, Simkin is suing his ex-wife. Before the divorce, he and his then-wife, Laura Blank, had $5.4 million in a Madoff account, under his name. In the settlement, Simkin withdrew some of the Madoff money and put it toward a $6.6 million cash payment--half the value of the couple's total assets--to Blank. He continued to invest with Madoff after the divorce; his ex did not. When Madoff's operation was revealed to be a Ponzi scheme in December 2008, Simkin's investments went up in smoke. It happens many times when an applicant is not granted an indefinite leave to remain. To counter this; you might want to consider an appeal for ILR refusal to the UK Border Agency according to the UK Immigration law. This refusal of this privilege could have been a result of many factors but the UK Border Agency will send you a letter explaining why your application of ILR was refused and you will also be informed if you are entitled to appeal or not. NM Appeals Court Orders Disclosure of Records in Police Case By Barry Massey/The Associated Press Tuesday, 17 August 2010 13:30 Court rules citizen complaints against police are public records and subject to public disclosure SANTA FE -- Citizen complaints brought against police are subject to public disclosure, according to a state Court of Appeals ruling that reinforces a New Mexico sunshine law granting access to government records. The court ruled against the state Department of Public Safety, which refused to release complaints against one of its law enforcement officers on grounds that they were confidential personnel records. In a unanimous ruling on Monday, the court disagreed and said the complaints were not covered by exceptions in the Inspection of Public Record Act that provide for the confidentiality of "matters of opinion in personnel files" and "letters of reference concerning employment." At issue was a public records request filed by a former captain with the state Motor Transportation Police Division, Charles Cox, who was fired in 2005 for making a racist comment about a patrolman who was black and for discrimination against a female employee. In 2006, Cox requested complaints that citizens had brought against the patrolman. Cox sued the department for not releasing the records and he contended that his firing was retaliation for exercising his right to free speech. There are many different lawyer classifications. Each of them is a legal expert who represents their clients based on specific areas of the law that their circumstances require. TRIPOLI/SANAA, Oct. 2 (Xinhua) -- Fighters from Libya's ruling National Transitional Council (NTC) continued their battles Saturday with the remnant forces of Muammar Gaddafi in Sirte, the fallen leader's hometown, causing casualties on both sides as well as to the civilians. The NTC troops ran up against heavy shootings by snipers loyal to Gaddafi at Sirte's western entrance, while explosions could be heard from inside the town, which had witnessed weeks of clashes, reported a Xinhua photographer near Sirte. This is a story about a man convicted of a cold case murder in Texas. The trial was in 2004 the murder happened 1988. The ONLY thing Steve is guilty of is hiring a defense lawyer that didn't give a hoot. In fact George Parnham only met with Steve twice in the year and a half that he had the case. Steve was writing him checks from day one and then every single day of the trial. If you have lost your job through no fault of your own, especially in the current difficult economy, unemployment benefits can be the difference between eviction or foreclosure and keeping your owned or rented home. In the U.S., unemployment benefits are significantly less generous than in most of our industrialized allied countries and trading partners; we Americans generally receive lower benefits and for a shorter period than do most Europeans, for example. Yet our modest, limited benefits can be crucial to surviving in a terrible economy.
Unemployment hearings in Maryland occur in three stages -
Appeals Lawyer
- The telephone or "claims specialist" stage
- The Lower Appeals or "Hearing Examiner" stage, and
- The Board of Appeals in some cases.
Basic Guide to Maryland Unemployment Insurance Appeals
Generally, the claims specialist conducts a mere telephone interview with the worker or "claimant" and with the employer, and renders a preliminary decision as to eligibility. If either party disagrees with the decision, either may file for an appeal of the decision to a hearing examiner for a "de novo" (all new, "do-over") hearing before the hearing examiner in an unemployment office location or other State office complex. That Lower Appeals hearing is recorded live, usually conducted in a small room and is generally limited to 45 minutes in length.
If the Lower Appeals decision reverses the telephone hearing, a dissatisfied party may appeal to the UI Board of Appeals; in most other cases, the appeals go to the Circuit Court for a judicial appeal that is based on the Lower Appeals record, i.e. NOT a "do-over from the top" but a review to determine legal errors and very gross factual errors only. Accordingly, it's important to take the Lower Appeals hearing seriously; it's worth it in most cases to hire an attorney or at least to consult with one.
The two main issues in unemployment cases are misconduct (of varying degrees) and voluntary quit for cause.
In a misconduct case, the employer has the burden of proof of showing conduct by the worker that either violates a fairly communicated workplace rule or otherwise manifested gross disregard for the interests of the employer. Misconduct grades run from (simple/petty) misconduct which involves a penalty of benefit "weeks", to gross misconduct and aggravated misconduct which bar all access to UI benefits until the worker is rehired and earns through wages/salary an amount of compensation equal to a large factor of the weekly benefit pay-out.
Voluntary quit for a serious justified cause related to the job itself allows the worker to keep unemployment benefits, whereas voluntary quit for the lesser "valid circumstances" related to the job or to the worker's personal circumstances may result in a penalty of benefit weeks. Voluntary quit for insufficient cause bars benefits entirely until a worker is rehired and earns back into the system. Sometimes, it's a close call whether a worker quit or was terminated.
Maryland has just increased the penalties for workers who get fired for misconduct; effective March 1, 2011 the penalty will be the loss of 10-15 weeks (up from 5-10 weeks) of benefits for a misconduct firing, and a requirement to earn 25 benefit weeks (up from 20 weeks) worth of wages for a gross misconduct firing before being re-admitted to eligibility. It's more important now than ever to consider hiring legal counsel in Maryland in a misconduct claim due to the even higher stakes for a loss.
Most Maryland attorneys do not do unemployment hearings; there's a reason why you see advertisements for car accident lawyers and medical malpractice lawyers and DWI/DUI lawyers, but almost none for unemployment insurance lawyers. One might think that in this economy, the demand for unemployment attorneys would be very high - and demand is so high that at least one Bar Association Lawyer Referral Service in Maryland has been soliciting lawyers to take more of these cases. Legal fees in unemployment cases are capped by state regulation and a somewhat burdensome review of the bills by the Unemployment Insurance office. Accordingly, most attorneys shy away from these cases for those reasons. Fortunately, some lawyers do practice in this area in Maryland.

This is the northwest corner of my property along Rt. 104, and a view of my right-of-way to the highway. I own some land on the outside of this fence, too. The fence has been battered, leaving a rather wobbly fence line. I have seen use of a backhoe, a Bobcat and a Mack truck to batter the fence a little at a time. I've had to replace this corner post several times -- sometimes it is snapped off. It is a solid steel t-post set 2-3 feet deep in the ground. The green material is tennis-court fabric used to create a wind-break for my plantings on the earth berm. Under the fabric, the heavy-duty cattle-panel fence has been twisted and bent. The fence has been under-cut in several places and asphalt applied on my property right up to the fence. The survey marker was obliterated by the asphalt job. Bartoszewski's asphalting was done by contractor Heath Combes in October 2007, just before Combes was appointed in November to the Hannibal Zoning Board of Appeals to hear Bart's appeal for a variance. The Hannibal Town Board, Town Commissioner and Lawyer had to write and pass a new law in order to replace an existing zoning-board member with Bart's contractor in the middle of the appeal for a variance for his illegal building. The plaintiff files a complaint outlining the case against the defendant. The complaint requests payment of damages.
Serving the summons (Service of Process)
The defendant receives notification of the lawsuit and a time limit to respond. The court now has jurisdiction over the case.
Answer
The defendant responds to all aspects of the complaint by admitting, denying, or stating insufficient evidence. At this point the defendant may also provide arguments to show that he or is not liable.
Counterclaim and responses
The defendant may raise a claim against the plaintiff (for example, holding the plaintiff liable for damages, not the defendant). The defendant answers the counterclaim admitting, denying, or stating insufficient evidence and argues why the counterclaim is not valid.

Discovery
Both parties in the injury litigation case disclose relevant information and documents before trial through interrogatories or requests for admission, depositions (oral interviews under oath), and production and inspection of documentation.
Pre-trial motions
Lawyers may enter motions to resolve the case, such as:
Summary judgment-undisputed facts compel a ruling without trial
Motion to dismiss-lack of material facts require dismissal of the case
Default judgment-lack of defendant response or appearance prevents defendant from contesting the case and the court rules on damages
Trial
Trial begins with jury selection (except in a bench trial when only a judge rules). Lawyers give opening statements. Each side provides evidence and testimony, cross-examines witnesses, and presents closing arguments. The judge instructs the jury members and sends them to deliberate. The jury returns, rendering a verdict.
Judgment and appeal
If the plaintiff wins, the defendant receives a judgment ordering payment of damages. Motions for enforcement become necessary when the defendant does not pay. Either party may appeal the verdict, which refers the matter to a higher court.
