Today, the Supreme Court of Azerbaijan heard the appeal filed against the Baku Appeals Court decision on Ismayil Bagvanov's lawsuit demanding the restoration of his property right. Bagvanov is one of the residents of the building on 44 Fuzuli street who saw their apartments demolished to make room for the construction of the Winter Boulevard development. Bagcanov, who rejected Baku City Executive Power's compensation offer of 1500 AZN per square meter, went to court to seek compensation for his violated property rights. According to Bagvanov's lawyer, Shafa Jamalzada, the Supreme Court reversed the Appeal Court's decision which had ruled that the Finance Ministry should pay the compensation to the apartment owner. Now, it is the Baku City Executive Power that has to pay. Another resident of the same building, Parviz Amirov, had a similar lawsuit with Local Economic Court #1 postponed because the defendant -- the Baku City Executive Power representative -- failed to show up. The process was postponed.

A New York Court of Appeals decision, reported in the New York Law Journal on June 1st, 2012, decided that a parent, even with custodial rights over his or her child could be found guilty of kidnapping. In The People v. Leonard, the father of a six-week-old baby held is baby hostage, with a large knife by her throat, and released her only after a one-hour standoff in which he threatened to kill the baby if the police approached him. The father was not married to the mother of the baby and the mother did not have sole custody of the baby. The court looked to decisions made in other states, as well as New York State, before reaching a decision. The court ruled that the father prohibited the movement of a child. He had driven to Ulster County from Brooklyn to pick up and kidnap the baby and committed Second Degree Kidnapping, usually not committed by a custodial parent. Thank you very much.

I don't think the 5th Circuit is making any sort of judgment on the actions here." Branham was consulted as by CBS 11 as a legal analyst and is not involved in the lawsuit. The decision, however, reinstates the US Securities and Exchange Commission's civil lawsuit against Cuban, who is accused of using confidential insider information when he decided to sell his shares in the search engine Mamma.com in 2004. His sale saved him about $750000 in losses. A Dallas federal judge had originally dismissed the case, but the appeals court's decision means Cuban is headed back to court. Today, the Azerbaijan Supreme Court heard the cassation appeal filed by the arrested youth activist and member of Popular Front Party Jabbar Savalanli. Judge Imran Hajigayibov presided over the hearing. The appeal was filed against the Sumgayit Appeals Court decision to sentence Savalanli to 2.5 years in jail for the possession of illegal drugs. Although representatives from British, French and Norwegian embassies , and a number of media representatives attended the proceeding, no measures were taken to allow the youth activist to attend the court hearing. Savalanli's lawyer, Asabali Mustafayev, said that the cassation appeal requests the annulment of the court of first instance's decision ( the decision of Baku Appeal Court) to sentence Savalanli to 2.5 years in prison, and Savalanli's acquittal. He also said that the initial investigation and court process failed to identify the origin of the illegal drugs which were found in Savalanli's pocket and Jabbar's personal immunity was violated during the investigation. In addition to a suspect investigation, the courts have refused to grant a number of motions filed by the defendant's side. This morning, Ted Olson — the conservative lawyer who represented President Bush in Bush v. Gore — appeared on Fox News Sunday to discuss his recent victory in overturning Proposition 8, which banned same-sex marriages in California. Throughout the interview, host Chris Wallace attempted to trip up his guest with a series of familiar Republican talking points, all of which Olson repudiated. Wallace asked Olson to identify the right to same-sex marriage in the constitution and wondered why "seven million Californians" "don't get to say that marriage is between a man and a woman." "Ted Olson To Chris Wallace On Marriage Equality: 'Would You Like Fox's Right To Free Press Put Up To A Vote?' This morning, Ted Olson — the conservative lawyer who represented President Bush in Bush v. Gore — appeared on Fox News Sunday to discuss his recent victory in overturning Proposition 8, which banned same-sex marriages in California. Throughout the interview, host Chris Wallace attempted to trip up his guest with a series of familiar Republican talking points, all of which Olson repudiated. Wallace asked Olson to identify the right to same-sex marriage in the constitution and wondered why "seven million Californians" "don't get to say that marriage is between a man and a woman." Olson replied that the Supreme Court has ruled that marriage was a fundamental right and pointed out that the constitution made no explicit mention of interracial marriage either. He stressed that under our system of government, voters can't deprive minority groups of their constitutionally guaranteed protections and reminded Wallace that in the 1960s, "Californians voted to change their constitution to say that you could discriminate on the basis of race in the sale of your home; the United States Supreme Court struck that down." What if you must go to Tax Court? After an IRS audit, you went to the IRS Appeals Division but did not receive an offer that was attractive based on the strength of your matter. Assume the corporation loaned you $1000000, which the IRS auditor proposed to treat as compensation to you, and the Appeals Officer offers a deal meaning you must include $800000 as compensation. Should you continue to fight to the United States Tax Court? The Tax Court exists so taxpayers can continue to fight without paying the tax. Each of the 19 judges was previously a tax lawyer and serves a 15 year term. The IRS wins about 90% of the Tax Court cases. However, that's because taxpayers represent themselves in about 90% of the cases. When taxpayers are represented by counsel, taxpayers have a much higher winning percentage. It costs only $60 to file a petition in Tax Court. The cost to try the case in which factual disputes are few, might be as little as $50000. In the matter involving the disputed loan, because there must be witnesses, the cost would be more like $100000, which, with $400000 of tax at risk, not to mention interest and penalties, might be a very good investment.
