Mark Cuban Insider Trading Allegations - Trey Branham

Dallas lawyer Trey Branham tells CBS 11 (KTVT) reporter Jack Fink that the 5th US Circuit Court of Appeals' decision in an insider trading case against Dallas Mavericks owner Mark Cuban doesn't mean the appeals court "is saying Cuban has done anything wrong. I don't think the 5th Circuit is making any sort of judgment on the actions here." Branham was consulted as by CBS 11 as a legal analyst and is not involved in the lawsuit. The decision, however, reinstates the US Securities and Exchange Commission's civil lawsuit against Cuban, who is accused of using confidential insider information when he decided to sell his shares in the search engine Mamma.com in 2004. His sale saved him about $750000 in losses. A Dallas federal judge had originally dismissed the case, but the appeals court's decision means Cuban is headed back to court. SUPREME COURT UPHELD JABBAR SAVALANLI'S SENTENCE

Today, the Azerbaijan Supreme Court heard the cassation appeal filed by the arrested youth activist and member of Popular Front Party Jabbar Savalanli. Judge Imran Hajigayibov presided over the hearing. The appeal was filed against the Sumgayit Appeals Court decision to sentence Savalanli to 2.5 years in jail for the possession of illegal drugs. Although representatives from British, French and Norwegian embassies , and a number of media representatives attended the proceeding, no measures were taken to allow the youth activist to attend the court hearing. Savalanli's lawyer, Asabali Mustafayev, said that the cassation appeal requests the annulment of the court of first instance's decision ( the decision of Baku Appeal Court) to sentence Savalanli to 2.5 years in prison, and Savalanli's acquittal. He also said that the initial investigation and court process failed to identify the origin of the illegal drugs which were found in Savalanli's pocket and Jabbar's personal immunity was violated during the investigation. In addition to a suspect investigation, the courts have refused to grant a number of motions filed by the defendant's side. According to Javalanli's lawyer, articles 6 and 14 of the European Court of Human Rights stipulating a fair trial and banning discrimination, have been violated. California Video Game Law on Appeal Can violent video games lead to violent children? The State of California thinks so. And to prove its point, California passed a law in 2005 making it illegal to sell violent videogames to anyone under the age of 18. The law prohibits the sale or rental of any a videogame to a minor that gives a player the option of "killing, maiming dismembering, or sexually assaulting an image of a human being." Under the law, videogame retailers would be subject to a $1000 fine for each infraction. Not surprisingly, software companies disagreed, as did numerous business groups, civil rights groups and several other states. They argue that the Constitution's 1st Amendment includes, by implication, the right to buy and use violent videogames. They also argue that self-policing through the industry's voluntary game ratings system, paired with parental oversight, provides sufficient protection. Last year, the 9th Circuit Court of Appeals sided with the software companies and declared the law unconstitutional. Now, the issue is before the United States Supreme Court. At stake are not only the rights of the under 18 video gaming community, but the revenues from a $10 billion a year entertainment industry. Then the movie shows an airplane carrying a passenger to an Indian reserve, where they're blockading construction/forestry equipment from clearcutting on Indian land. We later realize that the individual was a lawyer representing the tribe whose land is going to be clearcut and the protesters are angered at the lawyer losing the case & the lawyer came to discuss an appeals process. Wilf (Westerman) is introduced at this time & then he in turn introduces Arthur, who also kidnaps the logging company's general manager, and the four take off through the woods where Arthur "instructs" them in listening to Mother Earth. Surrealistic, in its entirety, throughout the movie you're taken for a ride that will take you through many thought provoking scenes. In particular where Wilf describes Washakeajack, the Indian trickster.
