If you have been charged with a crime in one of Utah's many justice courts, you need to be aware of your right to appeal. There are two trial court systems in Utah: district courts and justice courts. Felonies and serious misdemeanors must be prosecuted in the district courts. Justice courts have jurisdiction over less serious misdemeanors, traffic violations, and infractions. If you face charges in a justice court, you have the right to appeal any judgment of the justice court to a district court. The Utah code states, In a criminal case, a defendant is entitled to a trial de novo in the district court only if the defendant files a notice of appeal within 30 days of: (a) sentencing after a bench or jury trial, or a plea of guilty in the justice court resulting in a finding or verdict of guilt; or (b) a plea of guilty in the justice court that is held in abeyance. Utah Code Annotated § 78A-7-118. What this means is that after sentencing, a defendant may appeal to the district court for a trial de novo. "De novo" means "beginning again." The appeal resets the case to the very beginning and gives the defendant the right to a new trial. The defendant may also negotiate a different plea bargain. It is very important that a justice court case be appealed within 30 days of sentencing or pleading guilty on a plea in abeyance. Now his daughter Gege is appealing to Chinese leader Wen Jiaobao. She's hoping her letter will at least get an answer about Gao's whereabouts. For any kid, starting college is a new step in life. But for Gege—the daughter of renowned Chinese lawyer Gao Zhisheng—she will probably take that step without her father's guidance. Gao has been missing for more than 16 months. Now his daughter is appealing directly to Chinese leader Wen Jiaobao for his return. In her letter, published by Hong Kong's Apple Daily on August 25th, Gege tells Wen Jiaobao how life has been for the past five years. The family of four was thrown into turmoil after the Chinese regime gave Gao a suspended sentence for alleged subversion in 2006. Gege writes: "During this time, police lived in my house, in our apartment building. They even built a house two meters across from our window. I had to go to school by police escort, in the end, I couldn't go to school." Gege wrote to the Chinese leader, "Can you tell me where [my father] is? Can he call us? The special prosecutor in charge of trying Trayvon Martin's killer should be fired from the case because she has made it clear that her priority is to "get" George Zimmerman, says leading appeals case lawyer Alan Dershowitz in an exclusive Newsmax TV interview. Florida Gov. Rick Scott should never have appointed Angela Corey to the racially sensitive case in the first place, added the Harvard law professor. Yesterday, the Azerbaijan Supreme Court, under the chairmanship of judge Hafiz Nasibov, did not grant a cassation appeal filed by human rights defender Vidadi Isgandarov. Isganderov, who has been in prison since his April 17th arrest, was appealing the Shaki Appeals Court's October 18th, 2011 decision. Vidadi Isgandarov's lawyer Yalchin Imanov and public prosecutor Mahir Abbasov attended the court proceeding. Imanov filed a motion requesting the judge to allow Vidadi Isgandarov to attend the proceeding, but the judge decided that there is no need for his participation. . Isganderov was initially sentenced to 15 days of administrative detention by Nasimi District Court after being arrested on his way to the Public Chamber opposition coalition's April 17th protest. His imprisonment was then extended to three months of pre-trial detentionafter being officially charged under Articles 159.3 and 160.1 of the Criminal Code for obstructing the implementation of the right to vote and interfering with the operation of election commissions. On August 27th, 2011Goychay District Court sentenced him to 3 years in prison, a sentence that was upheld onNovember 2nd by the Shaki Appeals Court and yesterday by the Azerbaijan Supreme Court.

Willingham was put to death for setting a fire that killed his three young daughters. The Waco attorney represented Willingham in his final appeals, where he says he got to know the convicted killer. Reaves says Willingham didn't seem like the type who would hurt his own children. "He came across as someone who really cared for his kids". Fire investigators have no doubt that Willingham did intentionally set his Corsicana home on fire to hurt his ex-wife and mother of the children who died. However, Reaves saw holes in the case and believed Willingham was innocent, but it wasn't until a few days before his scheduled execution that he received a critical piece of evidence that he hoped would prove Willingham innocent. Reaves received a report from a renowned Austin scientist, Dr. Gerald Hurst, who authored a report on the fire, but wasn't paid for the findings. In the report. Dr. Hurst disputes the arson claim as "junk science". If there was no arson, there was no crime. Court after court, including the United States Supreme Court denied Willingham's request for a stay.
