Consumer lawyer John Watts of Birmingham, Alabama, discusses the right to appeal a decision entered by a judge in a Small Claims or District Court of Alabama. You have the right to appeal to Circuit Court if you are dissatisfied with the result you received in Small Claims or District Court. Normally the time limit is 14 days and there is a fee involved to appeal. The Circuit Court judge will normally not be concerned with the result in the lower court and you will start over. There are normally few appeals as most people understand that generally the orders entered by a District Court of Small Claims Court judge are fair and reflect what a jury or a Circuit Court judge will do. But all parties have the right to appeal and the right to have a jury which you can only have in Circuit Court.
