"Ted Olson To Chris Wallace On Marriage Equality: 'Would You Like Fox's Right To Free Press Put Up To A Vote?' This morning, Ted Olson — the conservative lawyer who represented President Bush in Bush v. Gore — appeared on Fox News Sunday to discuss his recent victory in overturning Proposition 8, which banned same-sex marriages in California. Throughout the interview, host Chris Wallace attempted to trip up his guest with a series of familiar Republican talking points, all of which Olson repudiated. Wallace asked Olson to identify the right to same-sex marriage in the constitution and wondered why "seven million Californians" "don't get to say that marriage is between a man and a woman." Olson replied that the Supreme Court has ruled that marriage was a fundamental right and pointed out that the constitution made no explicit mention of interracial marriage either. He stressed that under our system of government, voters can't deprive minority groups of their constitutionally guaranteed protections and reminded Wallace that in the 1960s, "Californians voted to change their constitution to say that you could discriminate on the basis of race in the sale of your home; the United States Supreme Court struck that down." When Wallace pressed the point further, likening same-sex marriage to abortion and noting that "the political process in the case of same-sex marriage was working" since states had been deciding the issue on a "state-by-state basis," Olson asked Wallace how he ...

What if you must go to Tax Court? After an IRS audit, you went to the IRS Appeals Division but did not receive an offer that was attractive based on the strength of your matter. Assume the corporation loaned you $1000000, which the IRS auditor proposed to treat as compensation to you, and the Appeals Officer offers a deal meaning you must include $800000 as compensation. Should you continue to fight to the United States Tax Court? The Tax Court exists so taxpayers can continue to fight without paying the tax. Each of the 19 judges was previously a tax lawyer and serves a 15 year term. The IRS wins about 90% of the Tax Court cases. However, that's because taxpayers represent themselves in about 90% of the cases. When taxpayers are represented by counsel, taxpayers have a much higher winning percentage. It costs only $60 to file a petition in Tax Court. The cost to try the case in which factual disputes are few, might be as little as $50000. In the matter involving the disputed loan, because there must be witnesses, the cost would be more like $100000, which, with $400000 of tax at risk, not to mention interest and penalties, might be a very good investment. State of Minnesota, Respondent v. Herman Tanksley, Jr., Appellant -- Case No. A10-0392: Appellant Herman Tanksley, Jr. was charged with two counts of fourth-degree driving while impaired. The charges were based, in part, on the results of a urine test indicating that Tanksley's alcohol concentration was .08 or higher within two hours of driving. Tanksley filed a motion to suppress the results of this urine test and requested a Frye-Mack hearing on the admissibility of first-void urine-alcohol test results. The district court denied these motions. The district court convicted Tanksley of fourth-degree driving while impaired, based on an alcohol concentration of .08 or higher, after a stipulated-facts trial. The court of appeals affirmed petitioner's conviction. On appeal to the supreme court, two issues are presented: (1) whether Tanksley was entitled to a Frye-Mack hearing on the admissibility of first-void urine-alcohol test results; and (2) if so, whether the denial of a Frye-Mack hearing was harmful.
