RESIDENTS OF FUZULI STREET FIGHT FOR THEIR PROPERTY RIGHTS

Today, the Supreme Court of Azerbaijan heard the appeal filed against the Baku Appeals Court decision on Ismayil Bagvanov's lawsuit demanding the restoration of his property right. Bagvanov is one of the residents of the building on 44 Fuzuli street who saw their apartments demolished to make room for the construction of the Winter Boulevard development. Bagcanov, who rejected Baku City Executive Power's compensation offer of 1500 AZN per square meter, went to court to seek compensation for his violated property rights. According to Bagvanov's lawyer, Shafa Jamalzada, the Supreme Court reversed the Appeal Court's decision which had ruled that the Finance Ministry should pay the compensation to the apartment owner. Now, it is the Baku City Executive Power that has to pay. Another resident of the same building, Parviz Amirov, had a similar lawsuit with Local Economic Court #1 postponed because the defendant -- the Baku City Executive Power representative -- failed to show up. The process was postponed.

"The Criminal Law Handbook: Know Your Rights, Survive the System" by Attorneys Paul Bergman & Sara J. Berman is an impressive 678 page tome of information all about criminal law. The book sets out to assist you with understanding the confusing rules and procedures involved with criminal offences and to teach you how the system works, why police, lawyers, and judges do what they do, and most importantly, what you can do to limit the harm. I feel it accomplishes that goal very well. Most of the book is written in an understandable question-and-answer format to explain the criminal justice system, both inside and outside the courtroom. It goes from initial police questioning through trials to prison and parole.

One must remember that Nolo focuses on making the law accessible to everyone, and the books published by Nolo do an outstanding job of doing just that. Therefore, this book isn't a criminal law text book as you would find in law school, but a comprehensive guide for the non-lawyer or layperson. For such a guide, it is very good and includes a lot of information.

Again, this book is a large tome of information. It is organized well and has many side-bars and examples. If you have a question regarding criminal law, more than likely this book will have an answer. The authors do point out that the law varies from state to state, and I'd recommend that besides this book, anyone dealing with the criminal system on their own look to the statutes in the jurisdiction they are in to ensure they have the law that is applicable to their case. That's why I really like that the final chapter provides guidance in this area. The authors also note that the book is not intended as a detailed guide to self-representation. It is a thorough overview of the entire system, but it's not everything, and that's because you can't put everything regarding our complex system in one book.

This is an excellent tour of the criminal justice system and one of the best resources around for the layperson who wants or needs to navigate the complex maze of rules and laws that make up our system. I recommend it highly for anyone who wants to know all about criminal law.

MaximsNewsNetwork: 10 March 2010 - UNTV: United Nations, Geneva - The United Nations (UN) Human Rights Council's Special Rapporteur on Torture Manfred Nowak said that almost no country can claim to have eliminated torture in law and in practice. Speaking to journalists in Geneva, Nowak called for the establishment of a World Court of Human Rights. This, he said could provide redress for victims of human rights violations including detainees. He added that it would be more effective than current UN systems where treaty bodies have no power to hand down binding decisions. Replying to questions, Nowak expressed concern about the fate of Chinese lawyer Gao Zhisagn, whom he met during a mission to China and whose current whereabouts are unknown. The UN expert said he had received no clear answers about Gao despite repeated appeals to the Chinese authorities for information. Asked about the United States record on torture, he said he had no evidence that the interrogation techniques used by the Bush administration had been continued under the Obama administration, nor was there evidence of secret places of detention. He regretted the failure to close Guantanamo Bay but attributed it to obstruction by the US Congress and the lack of assistance from European countries in accepting detainees. Nowak called for an investigation into the torture methods used by the former American government. Nowak is serving his fifth and final year as the Special Rapporteur on Torture ...

Supreme Court upholds damage awards for Charter Rights breaches

In 2002, Vancouver lawyer Alan Cameron Ward was arrested and strip-searched after police mistakenly believed he intended to throw a pie at then-Prime Minister Jean Chretien. Ward sued the city and provincial governments. The trial judge ruled that the city and province violated Ward's charter right to be free from unreasonable search and seizure. After a lengthy appeals process by the governments, the case went to the Supreme Court of Canada. On July 23, 2010 -- about eight years after the initial incident occurred -- the Supreme Court ruled that Canadians can receive monetary damages when their Charter Rights are violated, even if there has been no misconduct by authorities. Victoria-based personal injury lawyer Erik Magraken is a partner at The MacIsaac Group. He explains how Ward v. British Columbia will affect the public. Erik Magraken: What the Ward case does is it creates a new type of lawsuit: it permits people to sue the government and be awarded financial damages for constitutional wrongs. Do you understand your Miranda rights

Miranda v. Arizona, the case established the doctrine of the "Miranda rights." In 1963 Ernesto Miranda was arrested, an Arizona man on charges of kidnapping and raping a 18-year-old woman. While he was being questioned, confessed to Miranda, the crime and this evidence was later used to convict him. After several complaints, the court case was brought before the U.S. Supreme. The court ruled that the police had to inform Miranda of his right to remain silent and the right to aAttorney, the confession that was obtained during the interview was inadmissible as evidence because it violated Miranda's constitutional rights.

The Miranda rights are a reflection of the two rights guaranteed to all citizens by the U.S. Constitution: the right to self-incrimination and the right to avoid legal representation. The right to self load, commonly referred to as the right to remain silent is guaranteed by the Fifth Amendment of the Constitution. This right is also the originthe phrase "plead the fifth." The right to counsel prevents people taken advantage of by police and prosecutors. If you are arrested, you have the right to a lawyer before answering questions. These two rights were established long before the Miranda case, but the details of the case resulted in the ruling that defendants must be informed before being questioned about their rights. The police needed "to read anyone their rights" beforequestioning them, otherwise the information obtained from interrogations is inadmissible in court.

The proper Miranda warning provides the following information. "All have the right to remain silent, and what can you say will be used in court against you, you have the right lawyer to talk to a lawyer and have to take one. During any questioning.
