Is ADHD Protected Under the Americans with Disabilities Act?

The answer to the question is somewhat long and complicated. So we will begin with writing that while someone with ADHD may qualify for protection under the Americans with Disabilities Act, not everyone with the diagnosis of ADHD will qualify. And that may include you or your child.

The Americans with Disabilities Act was established by Congress in 1990. The purpose of the Act is to end discrimination against persons with disabilities when it comes to housing, education, public transportation, recreation, health services, voting, and access to public services. It also aims to provide equal employment opportunities for people with disabilities.

The ADA was written to offer protections to individuals with disabilities, not individuals with any particular diagnosis. The Americans with Disabilities Act seeks to protect individuals with significant impairments in function.

Is ADHD Protected Under the Americans with Disabilities Act?

By the way, it is estimated that the population of the United States is over 300 million persons. And it is estimate that about 19% of persons have some type of long-lasting condition or disability. That would be somewhere near 60 million persons. This includes about 3.5% with a sensory disability involving sight or hearing, about 8% with a condition that limits basic physical activities such as walking or lifting. It also includes millions of people with mental, emotional, or cognitive impairments.

Since Congress enacted the ADA courts have had several challenges in defining the scope of the Act.

What exactly is a disability?
Who would be defined as having a disability?
Is having a diagnosis the same as having a disability?

These are some of the questions that the courts have had to wrestle with, not to mention the questions related to how schools, work places, public transportation agencies, and more, are to implement the Act in daily operations with both employees and customers.

So, to the Question: Is Attention Deficit Hyperactivity - ADHD - included in the ADA?

The answer is "Yes, No, or Maybe."

The ADA defines "disability" as a physical or mental impairment that substantially limits
one or more "major life activities," such as walking, seeing, hearing, or learning. Having a
diagnosed impairment, such as ADHD, does not necessarily mean that an individual is disabled within the meaning of the ADA.

The ADA does provide for "mental" conditions or mental illnesses, and potentially ADHD fits in this category. But as with physical impairments, the diagnosis of a mental illness or mental impairment such as ADHD is not sufficient by itself to qualify for protection under ADA. Again, having a "diagnosis" is not the same as having a "disability."

We are not lawyers, and our readers probably are not either, but it is interesting to look at some of the recent court cases regarding the ADA that directly related to children or adults with Attention Deficit Hyperactivity Disorder.

These two cases seem to expand the definition of "major life activities" to include concentration and cognitive functions:

Brown v. Cox Medical Centers (8th Cir. 2002), where reportedly the court stated that the "ability to perform cognitive functions" is a major life activity;
Gagliardo v. Connaught Laboratories, Inc. (3d Cir. 2002), where reportedly the court held that "concentrating and remembering (more generally, cognitive function)" are major life activities.

But the courts have placed limitations on the scope of the Act as well, and have not just tried to accommodate everyone with ADHD. The court has its limits, and they have ruled that the ADA has its limits.

For example Knapp v. City of Columbus (2006 U.S. App. LEXIS 17081) is the story of three firefighters with ADHD who wanted the City to make accommodations for them in their jobs. The U.S. Court of Appeals for the Sixth Circuit declined to extend ADA coverage to three firefighters who had Attention Deficit Hyperactivity Disorder.

Three firefighters had claimed that ADHD substantially limited their ability to learn, so the City should make accommodations for them. But the court held that the firefighters failed to establish that their ADHD met the standards to qualify as a disability under the ADA.

A very important limitation of Act involved a ruling from an earlier Supreme Court case with Toyota in 2002 which the Sixth Circuit Court used in this case with the firefighters. The Sixth Circuit applied the U.S. Supreme Court's test in Toyota Motor Mfg., Kentucky, Inc. v. Williams, 534 U.S. 184 (2002).

Under the Toyota Motor ruling the courts must consider whether the person making the claim is unable to perform the variety of tasks central to most people's daily lives, not whether the claimant is unable to perform the tasks associated with his or her specific job.

When applying this test, the Sixth Circuit wrote that when a person who is seeking protection or accommodations under the ADA can fully compensate for an impairment through medication, personal practice, or an alteration of behavior, a "disability," as defined by the Disabilities Act, does not exist.

In other words, if a child, teen, or adult with ADHD can "get the task done" or "get the job done" by using medications, applying behavioral management techniques, receiving counseling, using biofeedback, using Attend, or other treatment interventions, then they do not have a disability that is protected under the ADA.

In this court case, all three firefighters testified that taking Ritalin controlled their symptoms, and that they were able to fulfill their family and work obligations. Thus, an ADA disability was not found.

So, it would follow that if you, or your child, could function pretty well at work or in school when taking medication or Attend, or using some other treatment, no disability as defined under the ADA would exist - at least according to the 6th Circuit Court.

Also, it seems that as a result of this ruling, employers under the Sixth Circuit do not need to make accommodations for employees with ADHD under these conditions:

When the disorder has not been shown to substantially impair their ability to perform tasks central to daily life;
When the ADHD symptoms can be improved by medication or other treatments.

Here is a pretty good list from a major university of the conditions that must be met for ADHD to qualify for coverage and protection under the American with Disabilities Act of 1990:

The ADHD must cause significant impact or limitation in a major life activity or function;
The individual must be regarded as having a disability;
The individual must have a record of having been viewed as being disabled;
The applicant must also be able to perform the essential job functions with or without accommodations to qualify as an individual with a disability under the meaning of the Act.

To establish that an individual is covered under the ADA, documentation must indicate that a specific disability exists and that the identified disability substantially limits one or more major life activities. Documentation must also support the accommodations requested.

The evaluation must be conducted by a qualified professional, such as psychologist, neuropsychologist, psychiatrist, or other medical doctor who has had comprehensive training in the differential diagnosis of ADHD and direct experience with an adult ADHD population. The name, title, and professional credentials of the evaluator should be clearly stated. All reports should be on letterhead, typed, dated, signed and otherwise legible.
Documentation must be current. The diagnostic evaluation must adequately address the individual's current level of functioning and need for accommodations. In most cases, the evaluation must have been completed in the last three years. A school plan, such as an Individualized Education Plan (IEP) or 504 Plan, is insufficient documentation for a university, but can be included for consideration as part of a more comprehensive evaluative report.
Documentation necessary to substantiate the diagnosis must be comprehensive and include:
- Evidence of early impairment. Historical information must be presented to demonstrate symptoms in childhood which manifested in more than one setting.
- Evidence of current impairment, which may include presenting attentional symptoms and/or ongoing impulsive/hyperactive behaviors that significantly impair functioning in two or more settings. In addition, the diagnostic interview should include information from, but not limited to, the following sources: developmental history, family history, academic history, medical history, and prior psycho-educational test reports.
- Alternative diagnoses or explanations should be ruled out. The evaluator must investigate and discuss the possibility of dual diagnoses and alternative or coexisting mood, behavioral, neurological, and/or personality disorders that may confound the diagnosis of ADHD.
- Relevant testing information must be provided and all data must reflect a diagnosis of ADHD and a resultant substantial limitation to learning.
- Documentation must include a specific diagnosis. The diagnosis must include specific criteria based on the DSM-IV, including evidence of impairment during childhood, presentation of symptoms for at least the past six months, and clear evidence of significant impairment in two or more settings. The diagnostician should use direct language in the diagnosis of ADHD, avoiding the use of such terms as "suggests," "is indicative of," or "attentional problems."
- An interpretive summary must be provided that demonstrates that alternative explanations have been ruled out and that explains how the presence of ADHD was determined, the effects of any mitigating measures (such as medication), the substantial limitation to learning caused by the ADHD, and the rationale for specific accommodations.

Obviously, dealing with government regulations with their specific definitions can be very frustrating and difficult. It would be important to have realistic expectations in regards to the American with Disabilities Act and ADHD.

We would recommend getting legal advice from an attorney who specializes in educational law, or has expertise in the Americans with Disabilities Act, to learn more about how the ADA may apply in a specific case to a particular individual with ADHD.

The Supreme Court has ruled to uphold the original decision to imprison youth activist and blogger Bakhtiyar Hajiyev for evasion of military service, originally passed by the Ganja Appeals Court on July 6th of this year. Judge Imran Hajigayibov presided over the hearing. The process was open to the public. Hajiyev's lawyer Sadig Bagirov asked the court to allow his client to participate in the proceedings. The judge said that Hajiyev didn't want to attend. The lawyer argued that yesterday Hajiyev had sent a telegram to the court saying explicitly that he wanted to attend. Bagirov filed 3 motions. In the first motion, he asked for an appeal to be sent to the Constitutional Court demanding an investigation into the state's denial of alternative (ie non military) service to his client. The second motion demands recognition of the violation of Hajiyev's right to freedom. Decisions on Baktiyar Hajiyev's arrest were made in breach of protocol, based exclusively on a policeman's testimony, and without listening to the defendant side. In the 3rd motion, the lawyer asked the court to recognize that the 3rd Article against torture, as detailed in the European Convention on Human Rights, has been violated. The divorce decree is a document that states the basic information regarding the divorce, case number, the names of the parties, date of divorce, and the terms the parties have agreed upon or the court's decision. The divorce decree is usually only a few pages long.

The divorce decree is the final step in the divorce process. Though several documents are likely to have been generated through the process, the divorce decree is the most important. It gives the pertinent details of the settlement between the parties. The divorce decree outlines the financial responsibilities of each party. It dictates the division of property of the parties to the divorce. The divorce decree will name the responsible parties to the debts the couple has incurred during the marriage.

In that and similar situations, the wronged spouse has the option of returning to divorce court to recoup the lost funds. They may also have the ability to take their ex-spouse to court to try to recover the money.

Once a divorce decree is filed and issued, the parties to the divorce are free to remarry. Some states have laws that require a waiting period after the divorce decree before the parties are free to remarry. The divorce decree is legally binding. If either party to the divorce fails to meet their obligations as set forth in the divorce decree, the other party has the right to take legal action to rectify the situation. The wronged party could take the other party back to divorce court or to small claims court.

Besides a lawyer's competence, the client's next most weighty question is the price of the legal representation. I began practicing criminal law exclusively in 1989 and still carefully and deliberately set my fees. The fee should compensate me appropriately for the effort I anticipate defending my client. Additionally, the fee should be fair in that it's hopefully within the client's acceptable range. Nonetheless, when charging a legal fee I always err on the high side rather than the low.

Why should attorneys charge a premium fee? More importantly, why should clients be willing to pay? First, understand the premium fee accomplishes several objectives. It drives off low paying business you do not want anyway. It allows you to focus on quality instead of quantity. Furthermore, by reducing the number of cases you carry it allows your staff to deliver better client service. Consequently, I train my staff to dedicate themselves to extraordinary client service! This wisdom works well in the practice of law. Premium fees run-off a fair number of prospects. However, the clients that do pay get excellent and personalized service. In other words, I can work their cases more vigorously since I carry a lighter caseload.

Appeals Lawyer

In short, the best possible results come from a position of strength. Defending from a position of strength is to regularly think "outside the box," looking for innovative approaches in handling the case. However, "thinking outside the box" requires time... enormous time. So the fewer cases attorneys handle at a premium fee, the more time they have to address the specific needs of each client. The Bryan defense lawyer should strive to charge premium fees to maintain reasonable caseloads. Caseloads at levels where extraordinary client service can be provided.

The defense lawyers making a living on client volume are doing both their clients and themselves a disservice. Every client deserves the best effort we have. But attorneys can't provide extraordinary service when they are juggling 200 active cases simultaneously.

Finally, lawyers should not be afraid to charge premium fees. Clients should not be afraid to pay them. Certainly, the premium fee will exclude the price shopping prospects. But prospective clients fool themselves into believing they get quality service at a budget price. Setting fees will always remain a risk for the committed criminal defense lawyer. But without risk there is no reward. Risk big - win big. Risk little - win little. Lawyers... don't be afraid to charge the premium fee. Clients, don't be afraid to pay them. In the end the most expensive lawyer often turns out to be the cheapest.

Patent Malpractice Belongs in Federal Court

Malpractice claims against patent lawyers must be brought in federal court, the U.S. Court of Appeals for the Federal Circuit has ruled in two companion cases of first impression. The rulings extend federal jurisdiction to an area that is traditionally the exclusive province of state courts.

Even though legal malpractice claims arise out of state law, the CAFC said, they require interpretation of federal patent law and therefore fall within the federal courts' exclusive jurisdiction.

Appeals Lawyer

In the first of the two Oct. 15 decisions, Air Measurement Technologies v. Akin Gump Strauss Hauer & Feld, the CAFC held that the federal court had exclusive jurisdiction over a case alleging errors by counsel in patent prosecution and litigation. In the second, Immunocept v. Fulbright & Jaworski, it found federal jurisdiction over a case alleging attorney error in claim drafting.

Patent Malpractice Belongs in Federal Court

"We hold that at least where, as here, establishing patent infringement is a necessary element of a malpractice claim stemming from alleged mishandling of patent prosecution and earlier patent litigation, the issue is substantial and contested, and federal resolution of the issue was intended by Congress, there is "arising under" jurisdiction under (28 U.S.C.) § 1338," Chief Judge Paul Michel wrote in Air Measurement.

Question of Patent Law

Both cases came to the CAFC from the Western District of Texas. In Air Measurement, the plaintiff, Air Measurement Technologies (AMT), filed its malpractice complaint in state court but the law-firm defendants removed the case to federal court. AMT sought to return the case to state court, alleging that the federal court lacked subject-matter jurisdiction. When the district court denied the request, AMT appealed.

AMT had developed technology to protect firemen and other emergency personnel by monitoring oxygen levels in self-contained breathing apparatuses. The company later discovered that the attorney they had retained to patent the technology had made various mistakes in its prosecution and subsequent litigation.

AMT sued the lawyer and his law firms for legal malpractice and on other grounds, all based solely on Texas state law.

The CAFC considered these facts in light of the two-part test for determining federal jurisdiction in patent cases set out by the U.S. Supreme Court in the 1988 case, Christianson v. Colt Indus. Operating Corp. That case requires a finding that a complaint either alleges a cause of action created by federal patent law or turns on resolution of a substantial question of patent law.

That second prong applied here, the CAFC concluded, because an essential element in proving malpractice is proof that the plaintiff would have prevailed in the prior litigation but for the malpractice.
"Because proof of patent infringement is necessary to show AMT would have prevailed in the prior litigation, patent infringement is a 'necessary element' of AMT's malpractice claim and therefore apparently presents a substantial question of patent law conferring § 1338 jurisdiction," the CAFC reasoned.

Claim Drafting Mistake

In the second of the two cases decided by the CAFC, Immunocept had retained counsel to secure patent protection for "large pore hemofiltration" technology to treat sepsis, shock and other medical conditions. It later hired a second patent attorney to prosecute additional applications based on the technology.

When Immunocept sought investors to help bring the invention to market, one potential partner's due diligence revealed a fatal flaw in the drafting of the patent claim that severely limited its scope. Because of that, the partner withdrew its interest.

Immunocept sued its lawyers for malpractice in federal court, alleging the patent statute as the basis of jurisdiction. The law firm responded with a motion for summary judgment, alleging that the claim was barred by the statute of limitations and that the damages sought were overly speculative, which the district court granted.

On appeal, the CAFC ordered the parties to file briefs addressing the question of federal jurisdiction over the malpractice case. Both parties did so, agreeing that jurisdiction was proper.

Even though both parties agreed to federal jurisdiction, the CAFC decided to address the issue, based on its own authority to consider its jurisdiction. As in the Air Measurement case, it again looked to the Supreme Court's Christianson test to reach its result.

The CAFC noted that Immunocept's complaint alleged only one source of attorney error -- a claim drafting mistake. Immunocept could not prove its case without addressing the issue of the scope of the patent claim, and that brings the case under federal jurisdiction, the CAFC said.

"Because patent claim scope defines the scope of patent protection ... we surely consider claim scope to be a substantial question of patent law," the CAFC said. "As a determination of patent infringement serves as the basis of § 1338 jurisdiction over related state law claims, so does a determination of claim scope."

Thus, the CAFC concluded, it was satisfied that Congress intended the federal courts to have exclusive jurisdiction over malpractice cases involving the drafting and scope of a patent claim.

What is a Bank Levy?

A bank levy is when your bank account is frozen and all or part of the monies in your bank account is seized. Bank levy's can happen for many reasons, however the two most common are due to unpaid taxes and unpaid debt.

A bank levy just doesn't happen immediately; usually it is the result of a creditor trying to force a debtor to repay a debt. Obviously in the case of taxes, if the IRS has sent you a letter stating that you owe taxes and you either refuse to pay the debt or don't respond to their requests by either making a repayment plan or trying to work with them towards repayment, a tool they will use is a bank levy. They will freeze your accounts and seize any money in your account up to the amount that you owe.

Appeals Lawyer

The bank account can be almost any type of account (e.g. savings, checking, etc) and while most levy's occur in the US, the IRS or other creditors can sometimes go after off shore accounts. Once a bank levy is made on your account, any money that is in the account will be seized. If there is not enough money in the account, all money will be removed and your account will usually remain frozen until the debt is paid off.

What is a Bank Levy?

It should be noted that while the IRS are usually the ones that use this method the most, other creditors have used this method to receive repayment for their debts. For instance, if you have a judgment against you for a credit card debt, the creditor can file for a bank levy to be placed on your account. While state laws differ, in most cases certain monies in your account are exempt including welfare payments, social security payments, VA benefits, child support, etc. If a bank levy has been placed on your account by a creditor, you usually have 30 days to contest the levy (in the case that monies that were seized are exempt). If a bank levy occurs, you should contact the court to find out how to file for an exemption immediately.

It should be noted that a bank levy can occur quite frequently and it is not a one time event. A creditor can request a bank levy as many times as he or she would like to until the debt is paid off. Many banks charge a penalty to their customers if their bank account receives a levy. This amount can be over 0 each time. It should be noted that any checks that have been written before the event that have not been cashed will bounce, because your account is frozen. It should also be noted that withdrawals can not occur, but in many cases deposits can. So if you have received a bank levy and have your employer deposit money into your account, this money will be seized as well.

If you have lost your job through no fault of your own, especially in the current difficult economy, unemployment benefits can be the difference between eviction or foreclosure and keeping your owned or rented home. In the U.S., unemployment benefits are significantly less generous than in most of our industrialized allied countries and trading partners; we Americans generally receive lower benefits and for a shorter period than do most Europeans, for example. Yet our modest, limited benefits can be crucial to surviving in a terrible economy.

Unemployment hearings in Maryland occur in three stages -

Appeals Lawyer

- The telephone or "claims specialist" stage
- The Lower Appeals or "Hearing Examiner" stage, and
- The Board of Appeals in some cases.

Basic Guide to Maryland Unemployment Insurance Appeals

Generally, the claims specialist conducts a mere telephone interview with the worker or "claimant" and with the employer, and renders a preliminary decision as to eligibility. If either party disagrees with the decision, either may file for an appeal of the decision to a hearing examiner for a "de novo" (all new, "do-over") hearing before the hearing examiner in an unemployment office location or other State office complex. That Lower Appeals hearing is recorded live, usually conducted in a small room and is generally limited to 45 minutes in length.

If the Lower Appeals decision reverses the telephone hearing, a dissatisfied party may appeal to the UI Board of Appeals; in most other cases, the appeals go to the Circuit Court for a judicial appeal that is based on the Lower Appeals record, i.e. NOT a "do-over from the top" but a review to determine legal errors and very gross factual errors only. Accordingly, it's important to take the Lower Appeals hearing seriously; it's worth it in most cases to hire an attorney or at least to consult with one.

The two main issues in unemployment cases are misconduct (of varying degrees) and voluntary quit for cause.
In a misconduct case, the employer has the burden of proof of showing conduct by the worker that either violates a fairly communicated workplace rule or otherwise manifested gross disregard for the interests of the employer. Misconduct grades run from (simple/petty) misconduct which involves a penalty of benefit "weeks", to gross misconduct and aggravated misconduct which bar all access to UI benefits until the worker is rehired and earns through wages/salary an amount of compensation equal to a large factor of the weekly benefit pay-out.

Voluntary quit for a serious justified cause related to the job itself allows the worker to keep unemployment benefits, whereas voluntary quit for the lesser "valid circumstances" related to the job or to the worker's personal circumstances may result in a penalty of benefit weeks. Voluntary quit for insufficient cause bars benefits entirely until a worker is rehired and earns back into the system. Sometimes, it's a close call whether a worker quit or was terminated.

Maryland has just increased the penalties for workers who get fired for misconduct; effective March 1, 2011 the penalty will be the loss of 10-15 weeks (up from 5-10 weeks) of benefits for a misconduct firing, and a requirement to earn 25 benefit weeks (up from 20 weeks) worth of wages for a gross misconduct firing before being re-admitted to eligibility. It's more important now than ever to consider hiring legal counsel in Maryland in a misconduct claim due to the even higher stakes for a loss.

Most Maryland attorneys do not do unemployment hearings; there's a reason why you see advertisements for car accident lawyers and medical malpractice lawyers and DWI/DUI lawyers, but almost none for unemployment insurance lawyers. One might think that in this economy, the demand for unemployment attorneys would be very high - and demand is so high that at least one Bar Association Lawyer Referral Service in Maryland has been soliciting lawyers to take more of these cases. Legal fees in unemployment cases are capped by state regulation and a somewhat burdensome review of the bills by the Unemployment Insurance office. Accordingly, most attorneys shy away from these cases for those reasons. Fortunately, some lawyers do practice in this area in Maryland.

This is the northwest corner of my property along Rt. 104, and a view of my right-of-way to the highway. I own some land on the outside of this fence, too. The fence has been battered, leaving a rather wobbly fence line. I have seen use of a backhoe, a Bobcat and a Mack truck to batter the fence a little at a time. I've had to replace this corner post several times -- sometimes it is snapped off. It is a solid steel t-post set 2-3 feet deep in the ground. The green material is tennis-court fabric used to create a wind-break for my plantings on the earth berm. Under the fabric, the heavy-duty cattle-panel fence has been twisted and bent. The fence has been under-cut in several places and asphalt applied on my property right up to the fence. The survey marker was obliterated by the asphalt job. Bartoszewski's asphalting was done by contractor Heath Combes in October 2007, just before Combes was appointed in November to the Hannibal Zoning Board of Appeals to hear Bart's appeal for a variance. The Hannibal Town Board, Town Commissioner and Lawyer had to write and pass a new law in order to replace an existing zoning-board member with Bart's contractor in the middle of the appeal for a variance for his illegal building. Later, Judge Seiter of the Supreme Court of the State of New York found this unacceptable, overturned the variance and sent it back.
